I didn't have any issues with most of the trial (this is a fictional show). My only issue was when Matt (the lawyer) started testifying instead of questioning the witness. I'm not a lawyer, & I never studied law but the scene was so blatantly hollywoood and it was just a bad scene.

It’s right that traps are not legal, but unsafe conditions in a locked building (intended to keep people safely away from the unsafe conditions), pets, etc should not be subject to a criminal’s subsequent lawsuit. In short, there should be intent to set a trap before there can be liability.

I would like more evidence to be provided to determine decisive proof. Many other comments are correct in the lack of accuracy in Phoenix Wright in terms of absurdity and dramatic effect (examples: shortened timelines, cross-examining a parrot and questioning the channeling procedures of spirit mediums). However, I am curious as to his thoughts on a Phoenix Wright case in terms of gathering evidence and talking to the defendant beforehand. Therefore, I would like to request Legal Eagle react to a case other than the first, which in the game version acts as almost a tutorial for how to play the game.

Why is "can't work because I don't have the part I ordered" not reasonably foreseeable? If I order a pizza and it doesn't show up I can't eat and the place I've ordered the pizza from can reasonably tell this fact given how location of physical objects works. If I order anything I cannot use that thing till it arrives. Therefore it is VERY easy to foresee that a part used to generate income would not generate income when that part is not delivered.

The case in which Roger Stone lied to congress began with a FiISA application where a lawyer blatantly lied to get a warrant, in fact over the next few years lied 17 times to keep the case going. if this had been any other case the judge would have dismissed the case and everyone who's life has been ruined by it would have been free to go. The suit salesman must not know it's illegal to lie on a warrant application.

Stone was never forced to lie and do the several other things he was found guilty of. Accusing others of a crime in no way excuses crimes. So far, nobody has been charged with making any intentional false statements to obtain the warrant. Thus there is a person who has been found guilty vs people who have not even been charged. If this had been any other case, we would never hear about Stone as he sits in jail.

This Lawyer isn't very bright when it comes to proper court attire. Data is wearing his Uniform which in Starfleet would be adequate and expected. Though usually a Dress Uniform would be used, Data wearing his standard issue uniform is perfectly acceptable and in this case would be considered proper protocol and mandatory. I loved this episode but it was completely redundant and just a filler episode. Data was a commissioned Starfleet officer not an honorary one. Starfleet recognizes lifeforms beyond what Humans perceive them to be and would have objected fiercely at the claims made by this scientist guy. He also would have been protected under many Regulations and would also have full rights same as anyone else in Starfleet upon that commission. This episode would have never happened if they were to follow Starfleet regulations and guidelines.

I don't know if this is an objection as much as just a point of clarification responding to the comments - two primary things I've seen are the issue that the bargain requires the consent of the 'child', and secondly that this 'isn't really a law'. Firstly, on the child point - that really raises a couple of different issues. First, it assumes children can consent to contracts, which I would suggest that even in an analogous medieval context is dubious. Assuming that the child can consent, then the second issue is privity of contract (I know, I know this is assuming the 'law' is similar to contracts as we understand them) - the 'child' is not a party to the contract and thus whilst they can receive benefit, it seems absolutely wild that they can dictate performance. If that were the case, then surely most of these contracts would be bad faith, ie 'I know my child is going to greet me, my child is unlikely to go with this stranger, therefore sure I accept the law of surprise knowing you will get nothing.' On the points that this 'isn't law' - I think it's very comparable to early maritime and international law, as well as laws arising out of the canon law in England. Just because there isn't an automatic or formal enforcement in the way that law appears today, doesn't mean that the law wasn't expected to be followed, or that there weren't penalties for breaching law. The law of one's word or oath was especially important. We now think of laws as codified and identifiable, but early trial processes involving a travelling shire reeve (sheriff). It's also important to consider that in medieval society there really wasn't the same division between religious, superstitious and legal rules that there is now. Just because it's a tradition which might pre-date the moral code of the legal sovereign law would not have made it less a part of the legal fabric of the time, much in the same way as multiple legal systems can apply to any single action. A final point I don't see mentioned is the role of the King in contract. Things can be a bit tricky when any head of state is involved with a legal obligation, particularly to a person who is not part of their sovereign state.

Honestly i think that the Brineys were in the wrong setting up the trap. They were not home so they were not justified in using lethal force to defend themselves, there was no physical harm that would have come to them since they were away from home while the trap was set up. If they were actually threatened by the burglar or actually at their home when it was invaded then it they have a bit more of a leg to stand on in terms of setting up a deadly trap to defend their lives from someone invading their home, BUT they had left their home with the trap still actively set up and purposefully hidden. The argument about if he had cut himself on glass breaking a window is a completely different. With that, he caused damage to the property and harmed himself while doing so. In that theoretical situation he caused the harm to himself while trespassing. In the situation that actually happened, the harmful element was purposefully placed by the homeowner and in that situation there was no possible way he could have physically harmed them due to them leaving their home with the trap active, thus they were not justified in using actively lethal force against a trespasser. I think the key element is that they were using deadly force to defend an at the time empty property. The man did go to jail and paid for the crimes he committed, those crimes do not justify having his leg be permanently damaged and him being at least partially crippling him for the rest of his life. If they were home with the trap set up while the burglary happened then it would have been barely different from if Mr Briney himself used the shotgun to shoot him to defend himself from someone who had broken into his home, That is self defense. This was not. EDIT: oh hey! i was actually correct. the main thing that made the difference was they weren't home and thus he was not a threat to their life, nor was he being violent, so the deadly trap was wrong to do. one life was threatened, and it was not the homeowners. wow i think i had a good understanding of the law there for someone who only found this channel recently and has watched maybe 5 of your videos before this, has no experience in law, and doesn't even have an excuse of watching law & order a bunch or something similar. i just draw pictures for a living, didn't think i'd correctly figure out how those laws work. it probably has more to do with how you've relayed legal information and taught some law threw these videos then me being a fast learner or something. so good job on that front.

The point of Wikileaks is that the party usually retains anonymity as a simple safeguard. As for the "hack", the Russians sent a simple phishing email to a DNC official, prentending to be Google asking for their Gmail password. The official asked the IT help for advice. The help desker made an egregious typo in responding: ok to give the password- omitting the "not" he intended. May it please the court, Assange offered testimony last week that Trump offered Assange a pardon if he would say the Russians had nothing to do with the email leaks. Assange refused. Objection: Product liability would not be appropriate as you mention at 3:50. That cage transfer system was likely specially designed in-house by Jurassic Park engineers as there would be no commercially available "dinosaur transport" system. If the park was using a system that was meant for other exotic animals but not dinosaurs, then that would be the case of unforeseeable misuse of the product and the producer could not be liable. Edit for second objection: At 7:40 you talk about product liability for the dinosaurs themselves and that does not take into account the fact that large carnivorous dinosaurs are an inherently dangerous product, that cannot be rendered more safe, and that the purchaser of the product knows of the danger.

Reminds me of the best advice given to me by a Wa police officer: if someone breaks into your home and you intend to defend it, make sure you kill them. They can't sue you if they're dead nor can they speak as to what actually happened, and if you let them live, they will win. Personally, I believe that if you have broken into a house (not just wandered onto a property), your rights to life and limb should be forfeit. However, booby traps pose a risk to say, police officers that may need to gain access to the residence legally, so I understand the ruling at least.

In addition to Trump's interference in this case he has cast doubt on the principle of equal justice under the law. Trump just days before this travesty of justice he perpetrated on the DOJ, he also handed out pardons to all of his political cronies who are in jail in addition to his fat cat friends. Good ruling. He may be a criminal but the trap was immoral and too far. People in this comment section disappoint me. They are completely dehumanizing that person and are frothing at the mouth for the chance to to commit the act them selves. Commenters are reveling in the suffering caused by the trap.

I'm 50 and retired and thinking about going to school and maybe study law. Wouldn't filing a baseless lawsuit with the intent of causing harm be cause to counter sue? Couldn't The John Oliver Show and HBO have counter sued Bob Murray for the baseless lawsuit?
